Judicial Panel to Reconsider Ruling That Allowed Trump to Deploy Military Forces to Portland

Appeals Court Agrees to Rehear Legal Matter

The ninth circuit court of appeals ruled on this week that it would rehear the case concerning the president’s authority with an expanded panel of eleven justices. The court also overturned a earlier decision from a smaller judicial group that had supported the administration.

Ongoing Dispute Over Troop Deployment

This order represents the most recent development in a protracted legal battle over whether the administration has the legal right and valid reason to send national guard forces in the city. Approximately 200 federalized guard members have been in limbo since late September when the deployment effort was initiated in response to months of protests.

Conflicting Arguments

The administration has argued that federal officials at the ICE facility in south Portland were facing threats, while local authorities maintain that municipal police have control of the circumstances.

In defiance of descriptions of the city as “war ravaged”, residents have been posting videos of scenic paths and a thriving food scene, and planning activities such as an Emergency Naked Bike Ride against the “militarization of our city”.

Court Proceedings

The Tuesday ruling came after a US district judge in the city issued two temporary restraining orders this month – one preventing the federal control of the Oregon national guard, and another prohibiting the deployment of any national guard troops in the state, after efforts to evade the initial injunction by mobilizing out-of-state forces.

On Monday, the appeals court had temporarily suspended the initial decision – allowing control of state troops – but the second ruling stayed effective, preventing the physical sending of the forces.

Full Panel Consideration

The Tuesday decision means the issue will be heard “en banc” – with both rulings under consideration together – by a panel of 11 judges.

“This decision shows that facts are important and that the judicial system are striving to hold this administration accountable. The founding document restricts the executive authority, and local populations cannot be treated as a training ground for expansive government power,” said the legal representative in a statement.

“The judicial body is sending a clear message: the president cannot dispatch the military into American urban areas unnecessarily. We will continue protecting state legislation, values, and sovereignty as this case progresses and our fight continues in the judicial system.”
